SKYELINK DIGITAL PROFILE AGREEMENT & PRIVACY POLICY

Welcome to the unified platform of SkyElink Corporation (accessible via sky-link.com).
This comprehensive agreement governs all products, smart Near Field Communication (NFC) and Quick Response (QR) code enabled solutions, and digital profile services offered under our ecosystem. By purchasing, activating, or inputting identity details into any product hosted on our platform, you agree to these terms.
This document complies with the Data Privacy Act of 2012 (Republic Act No. 10173) of the Philippines, its Implementing Rules and Regulations (IRR), and related legal frameworks.
1. Scope of the Unified Platform
This agreement applies universally across all specialized business segments and cards operated by SkyElink Corporation, including but not limited to:
- SnapTap Pro: Professional NFC & QR Cards for corporate networking, identity sharing, and lead capture.
- Peacebook Card: Digital memorial and remembrance profiles honoring loved ones.
- Event Invitation Card: Interactive digital invites and guest management for personal or corporate gatherings.
- SafeRide Card: Enhanced safety profile and emergency information sharing for commuters and travelers.
- Custom Establishment Cards: Tailored business profiles designed for restaurants, gyms, salons, hotels, and schools.
2. Collection of Information and Identity Entry
Depending on the specific SkyElink card or service utilized, our system collects the following personal or sensitive personal data that you or your authorized representatives manually input:
- Professional Identity (SnapTap Pro / Establishment Cards): Full name, designatory initials, position, company name, corporate email, mobile numbers, and social media hyperlinks.
- Memorial Data (Peacebook Card): Names of the deceased, biographical history, uploaded multimedia files, and family contact registries.
- Logistical Details (Event Invitation Card): Event locations, times, RSVP lists, and dietary or special guest criteria.
- Safety Data (SafeRide Card): Blood type, emergency contact hotlines, insurance policies, and frequent commuter paths.
3. Purpose of Processing and Explicit Consent
By inputting identity data into any sector of the platform, you give explicit, unambiguous consent to process data for:
- Public Link Generation: Publishing a cloud-hosted digital profile tethered to your physical NFC chip or printed QR code.
- Functional Transmission: Displaying details immediately upon a physical "tap" or visual "scan" by any smartphone.
- Platform Maintenance: Securing the cloud infrastructure against unauthorized modifications.
4. Intellectual Property and Proprietary Rights
All content, features, and functionality within the platform are the exclusive property of SkyElink Corporation.
- Proprietary Elements: This protection covers our custom card designs, brand names, trademarks, logos, system architecture, user interface graphics, and the proprietary dashboard source code running on sky-link.com.
- User Restrictions: You are granted a limited, non-exclusive license to use your digital business card and profile dashboard. You may not copy, reverse-engineer, modify, distribute, or attempt to replicate our source code, web interface, physical chip layouts, or unique card aesthetics without prior written consent from SkyElink Corporation. Unauthorized reproduction will be prosecuted to the fullest extent under the Intellectual Property Code of the Philippines (Republic Act No. 8293).
5. User-Uploaded Content Policy and Acceptable Use
You retain ownership of any media, text, images, or logos you upload to your profile dashboard. However, you grant SkyElink Corporation a non-exclusive license to host and display this content.
- Prohibited Content: You are strictly prohibited from uploading, posting, or transmitting any content that is illegal, defamatory, obscene, pornographic, harassing, threatening, or infringing on third-party intellectual property rights.
- Compliance with Philippine Law: Content must comply with the Cybercrime Prevention Act of 2012 (Republic Act No. 10175) and the Revised Penal Code.
- Right to Moderate: SkyElink Corporation reserves the absolute right to review, flag, suspend, or permanently delete any profile or user account containing content deemed inappropriate or unlawful, without prior notice.
6. Public Accessibility and User Responsibility
- Intentional Disclosure: You acknowledge that the underlying function of the SkyElink platform is data transmission. Once an NFC card is physically tapped or a QR code is distributed, the chosen data fields are visible to the scanning party.
- Granular Profile Management: You retain absolute control over your digital dashboard and are strictly responsible for toggling which information fields remain visible to the scanning public.
7. Compliance with the Data Privacy Act (DPA) of 2012
SkyElink Corporation implements organizational, technical, and physical safeguards to defend your cloud profiles against illegal breaches, data corruption, or unauthorized altering. We explicitly recognize your legal rights as a Data Subject under Philippine law:
- Right to Access and Rectification: You can instantly log into your online dashboard at sky-link.com to inspect or update your active information.
- Right to Erasure or Blocking: You may request the absolute deletion or anonymization of your data profiles. This action renders any associated NFC or QR physical assets completely inert.
- Right to Object: You can opt-out of secondary processing actions, such as administrative updates or corporate platform newsletters.
8. Commercial Dispute Resolution and Jurisdiction
- Governing Law: This agreement shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
- Jurisdiction: In the event of any commercial dispute, breach of contract, or unresolved issues regarding subscription fees, payment structures, or services rendered, both parties agree to resolve the matter through amicable negotiations. If a settlement cannot be reached, the exclusive jurisdiction and venue for any legal action or court proceedings shall be the competent courts of Pasig City, Metro Manila, Philippines, to the exclusion of all other venues.
9. Limitation of Liability
SkyElink Corporation provides the platform infrastructure to connect the physical and digital environments. SkyElink is not legally liable for any third-party misuse, downstream replication, or unauthorized sharing of your information once it has been intentionally exposed via an NFC tap or QR scan in a public setting.
